RESOLUTIONS



CE11.R1

    The Executive Committee,

Considering that at its 10th Meeting the Committee approved a [proposed] program and budget [Document CD4/PP/1] to be submitted to the Directing Council at its IV Meeting;

Considering that [the aforesaid document] incorporates a considerable reduction below the [level of the] original [proposal] submitted by the Director of the Bureau to the 10th Meeting of the Executive Committee;

Resolves:

1.To submit [the proposed program and budget contained in Document CD4/PP/1 to] the Directing Council [for consideration] at its IV Meeting.

2.To add to the aforementioned document a tabular summary showing the manner in which the reductions were introduced into the [proposed] budget presented by the Director, as indicated in Document CD4/PP/1 (Add. 2).

    The Executive Committee, made the recommendation that was endorsed by the Directing Council and incorporated in Resolution CD4.R7, below.

    The Executive Committee,

Considering that serious and urgent reasons, as described by the Director, led him to spend an amount of $1,744.91 from the Emergency Fund at the time of the earthquake at Cuzco, Peru; and

Considering that this amount should be restored to the original amount of the Emergency Fund,

Resolves:

1. To approve the aforesaid expenditure.

2. To recommend to the Directing Council that the budget for 1951 be increased in the amount of $1,744.91 as a special assessment for the purpose of maintaining the Emergency Fund at the level of $50,000.

    The Executive Committee,

Considering that the Director's report contained in Document CD4/AFL/1, Rev. 1, describes the progress of the negotiations with the Governments of France, Great Britain, and the Netherlands regarding their participation in the Regional budget of the Americas; and

Considering that a verbal statement was made by the Observer from the Netherlands,

Resolves:

To take note of Document CD4/AFL/1, Rev. 1, and to submit it to the Directing Council for consideration at its IV Meeting.

    The Executive Committee,

Considering that the Executive Committee in its 10th Meeting 1 instructed the Director to negotiate with the United Nations through the World Health Organization for the admittance of the Pan American Sanitary Bureau staff into the United Nations Joint Staff Pension Plan; and

Considering that certain difficulties involved in such action have been discussed in correspondence between the Director and the World Health Organization,

Resolves:

1. To request the Director to continue negotiations with the United Nations through the World Health Organization to assure the presentation to the next session of the United Nations Joint Staff Pension Board of a request for admission of staff members of the Pan American Sanitary Bureau on the following basis:

a) The Agreement between the World Health Organization and the Pan American Sanitary Organization signed 24 May 1949, effective 1 July 1949, states:

The Pan American Sanitary Conference, through the Directing Council of the Pan American Sanitary Organization and the Pan American Sanitary Bureau, shall serve respectively as the Regional Committee and the Regional Office of the World Health Organization for the Western Hemisphere, within the provisions of the Constitution of the World Health Organization. In deference to tradition, both organizations shall retain their respective names, to which shall be added "Regional Committee of the World Health Organization" and "Regional Office of the World Health Organization," respectively.

b) The Pension Plan [should] be made mandatory for all personnel of the Pan American Sanitary Bureau serving as the Regional Office of the World Health Organization, except that approximately 15 staff members of the Pan American Sanitary Bureau having several years of service and contributions in the pension plan of the Pan American Union, or demonstrating other hardships, may be excluded from the United Nations Pension Plan.

c) The effective date of entry into the United Nations Joint Staff Pension Plan shall be 1 July 1949, the date of entry into force of the Agreement between the World Health Organization and the Pan American Sanitary Organization, subject to the availability of funds for payment of the Pan American Sanitary Organization share of the cost of crediting service since that time.

2. To authorize the Director to conclude any agreement that may be required in order to enter the United Nations Joint Staff Pension Plan and to report to the Executive Committee on the status of negotiations at its 13th Meeting.

    The Executive Committee,

Considering that the provisions of the Staff Provident Fund are by their terminology contingent upon adoption of the United Nations Joint Staff Pension Plan,

Resolves:

1. To approve the Staff Provident Fund on the condition that staff members of the Pan American Sanitary Bureau are admitted to membership in the United Nations Joint Staff Pension Plan.

2. To authorize the Director to bring these provisions into effect upon admission of the Pan American Sanitary Bureau into the said United Nations Joint Staff Pension Plan.

3. To authorize the Director to refer the matter again to the attention of the Executive Committee if the proposed admission to the United Nations Joint Staff Pension Plan is not consummated.

    The Executive Committee,

Considering that the World Health Organization has adopted Staff Rule 890 providing for certain field service allowances to staff members on temporary field duty;

Considering that the Director of the Pan American Sanitary Bureau has recommended that this rule not apply in respect to Pan American Sanitary Bureau staff members; and

Considering that the implications of this rule touch upon basic policy considerations in respect to relationships between the Pan American Sanitary Bureau and the Member Governments in the conduct of various health programs in the Hemisphere,

Resolves:

1. To recommend to the Directing Council that it give thorough consideration to the problems raised by [WHO] Staff Rule 890.

2. To include consideration of the incorporation of [WHO] Staff Rule 890 in the Staff Rules of the Pan American Sanitary Bureau on the agenda of the IV Meeting of the Directing Council.

    The Executive Committee,

Considering that changes made by the World Health Organization in its Staff Rules are normally reflected in similar action in respect to the Staff Rules of the Pan American Sanitary Bureau, unless special requirements of the latter make it inadvisable;

Considering that the Director has recommended that the Pan American Sanitary Bureau staff receive insurance coverage identical or similar to that received by World Health Organization staff; and

Considering that the Director has recommended that certain changes in the Pan American Sanitary Bureau Staff Rules be made to conform with changes in the World Health Organization Staff Rules, and that certain other changes not paralleling World Health Organization practice also be made,

Resolves:

1. To authorize the Director to adopt the World Health Organization insurance plan or, if that is not possible, a similar plan for the Pan American Sanitary Bureau staff.

2. To confirm the Director's action in respect to changes in Staff Rule 216.1, relating to period for reinstatement, and Staff Rules 933.1 and 952.4, relating to minimum charge of leave.

    The Executive Committee,

Considering that, for administrative and technical reasons, the exact date on which the Director takes office should he determined,

Resolves:

To recommend to the XIII Pan American Sanitary Conference that it adopt a resolution to the effect that henceforth the Director of the Pan American Sanitary Bureau assume office as of the first calendar day of the fourth month following his election.

    The Executive Committee,

Considering that, pursuant to Article 12, paragraph B, of the Constitution of the Pan American Sanitary Organization, it is the duty of the Executive Committee to approve the provisional agenda of meetings of the Council and of the Conference; and

Considering that at its 10th Meeting the Executive Committee set the dates of the aforementioned meetings, deciding that they should be held consecutively,

Resolves:

To approve the provisional agenda of the IV Meeting of the Directing Council as contained in Documents CD4/2 and Add. 1, 2, and 3 thereto, and the provisional agenda of the XIII Pan American Sanitary Conference as contained in Document CSP13/2.

    The Executive Committee,

Considering that the proposed Rules of Procedure (Document CD4/5) prepared for the IV Meeting of the Directing Council contain references to Associate Members, for which there is no constitutional provision,

Resolves:

1. To recommend to the Directing Council [that it] give favorable consideration to the adoption of the Rules of Procedure as amended in Document CD4/5 (Rev. 1, Corr. 1). 1

2. To recommend to the Directing Council [that it] eliminate the routine consideration of the Rules of Procedure and delete them from future agenda in the absence of a specific request from a Member Government or the Director of the Pan American Sanitary Bureau.

    The Executive Committee,

Considering that the proposed Rules of Procedure (Document CSP13/5) prepared for the XIII Pan American Sanitary Conference contain references to Associate Members, for which there is no constitutional provision,

Resolves:

1. To recommend to the Pan American Sanitary Conference [that it] give favorable consideration to the adoption of the Rules of Procedure as amended in Document CSP13/5, Rev. 1. 1

2. To recommend to the Pan American Sanitary Conference [that it] eliminate the routine consideration of the Rules of Procedure and delete them from future agenda in the absence of a specific request from a Member Government or from the Director of the Pan American Sanitary Bureau.

    The Executive Committee,

[Bearing in mind] that the draft International Sanitary Regulations have been considered by the Second and Third World Health Assemblies, and that final approval of this set of Regulations is expected to be given by the Fourth World Health Assembly; and

Considering that it is desirable to clarify the effect of the aforementioned Regulations on the existing Pan American Sanitary Code;

Resolves:

1. To recommend to the XIII Pan American Sanitary Conference that it consider the problem raised by the phraseology of Article 93 of the WHO draft International Sanitary Regulations.

2. To authorize the Director of the Pan American Sanitary Bureau to collaborate with the appropriate organs and officers of WHO with a view to safeguarding the status of the Pan American Sanitary Code, conveying to that body the assurances of the Pan American Sanitary Organization that it is entirely sympathetic to the concept of uniform international sanitary regulations and, furthermore, that [it] will take the necessary action, after the proposed International Sanitary Regulations have finally been approved by the World Health Assembly, to interpret the articles of the Pan American Sanitary Code in such a manner as not to conflict with the new International Sanitary Regulations.

    The Executive Committee,

Considering that the Pan American Sanitary Bureau should primarily attempt to solve the basic problems of public health, for which purpose a minimum program and budget for 1951 were approved by the Executive Committee; and

Considering that, despite the foregoing, a program to survey the dental needs of the Americas is important to the health of our peoples,

Resolves:

To include in the agenda of the 13th Meeting of the Executive Committee the study of dental public health needs in the Americas prepared by the Pan American Sanitary Bureau and presented at the 11th Meeting of the Committee.

    The Executive Committee,

Considering the difficulties encountered in attempting to establish in the Rules of Procedure the rights and privileges of States that do not have their seat of government within the Western Hemisphere and that have the right to participate in the Directing Council when it serves as Regional Committee of the World Health Organization;

Considering that full rights in the Directing Council and the Conference should be granted to these Governments, since it would otherwise be necessary to meet in separate sessions as Regional Committee of the World Health Organization; and

Considering that it is desirable to have as full participation as possible in international health work; that the Governments concerned, to which reference was made above, now have rights in the Directing Council and Conference when these bodies serve as Regional Committee; and that certain of these Governments have agreed to make contributions to the Regional budget and negotiations are now under way in regard to this matter,

Resolves:

To recommend to the Directing Council that it accept and propose to the XIII Pan American Sanitary Conference the adoption of an addition to Article 2, paragraph A, of the Constitution of the Pan American Sanitary Organization, which addition would be as follows:

After the words "... to membership in the Pan American Sanitary Organization":

States not having their seats of government within the Western Hemisphere which either

a) By reason of their Constitution consider certain territories or groups of territories in the Western Hemisphere as part of their national territory; or

b) Are responsible for the conduct of the international relations of territories or groups of territories within the Western Hemisphere, are entitled to membership.

    The Executive Committee,

The Director of the Pan American Sanitary Bureau, Regional Office of the World Health Organization, submitted for consideration by the Executive Committee a Progress Report on the Activities of the Bureau for the period 1 April to 31 July 1950 (Doc CEll/6) and Doc. CEll/6 (Add.l);

Resolves:

To note said Report and to compliment the Director on the progress achieved by the Bureau under his guidance during the above-mentioned period.

    The Executive Committee,

Considering that Dr. Alberto Zwanck has distinguished himself as an eminent public health worker and has made an important contribution in laying the foundations for the new activities of the Pan American Sanitary Organization and for greater brotherhood among the peoples of the Americas,

Resolves:

To recommend to the XIII Pan American Sanitary Conference that it express to Dr. Alberto Zwanck, in the form that it may deem appropriate, the appreciation of the Pan American Sanitary Organization for his outstanding service to the cause of public health in this Continent.
